Dining & Sightseeing Experiences Excluding Private Events & Charters

General

  • Conditions of Carriage apply to all bookings
  • Travel Insurance is strongly recommended
  • Groups over 60 guests are on request as special conditions and/or a private charter may apply
  • Refunds are not available for services not availed once travel has commenced
  • All refund claims must be made in writing
  • Refunds exclude cancellation fees, change of date fees and any third-party fees financial transaction fees including credit card surcharges
  • Additional terms and conditions may apply to Promotional Fares or Special Events that may be released on occasion, which will be written on promotional material, website or notified by Captain Cook Cruises accordingly
  • Agent commission may be limited or not available on special events and promotional fares

Ticketed Cruises

For bookings with less than 10 guests

  • Payment in full is required at the time of booking

For bookings with 10 or more guests

  • 30% deposit to confirm your booking
  • Balance due 7-days prior to travel
  • Please advise passengers numbers at the time of each payment
  • Bookings are only confirmed when paid in full
  • Captain Cook Cruises at all times reserves the right to release unsold seats if required
  • If we become full on your departure and/or cruise type, full payment will become due 7-days of notification

For bookings with less than 10 guests

  • One date change is permitted up to 24-hours prior to travel with any difference in the fare payable by the customer
  • Additional date changes incur a $20 per person non-refundable fee

For booking with 10 or more guests

  • One date change is permitted up to 7-days prior to travel, with any difference in the fare payable by the customer
  • Additional date changes incur a $20 per person non-refundable fee

For bookings with less than 10 guests

  • Cancellations notified less than 24-hours prior to travel incur a 100% cancellation fee

For bookings with 10 or more guests

  • Cancellations notified less than 7-days prior to travel incur a 100% cancellation fee

If we’re unable to operate, no cancellation fees apply. You may seek a refund from the original place of purchase, or a credit can be made with Captain Cook Cruises Sydney towards another cruise within 3 years of original date of travel. If purchased through a booking agent, please refer to the agent's terms and conditions.

Promotional Fares including Online Specials

Prices & Payment: as per Ticketed Cruises except

  • Prices are variable and valid at the time of payment only
  • Credit Accounts are not available with Promotional Fares - full payment is required at the time of booking
  • Limited agent commission applies

Date Changes: as per Ticketed Cruises except

  • Subject to the sale and travel periods of the promotion
  • Any difference in the fare due to date change is payable at the time of change

Cancellation: as per Ticketed Cruises Cancellation Clause

  • Promotional Fares cannot be combined with any other offer
  • Promotional Fares do not apply to Special Events
  • Valid for sale for a limited time only and subject to change without notice
  • Block out periods may apply
  • Limited inventory - only a select number of tickets are available at Promotional Fares on any given date
  • Please remember that it is the customer's responsibility to check the price carefully before payment is finalised
  • May only be available when purchased direct through Captain Cook Cruises

Ticketed Special Events

For bookings with less than 10 guests

For bookings with 10 or more guests

  • Captain Cook Cruises at all times reserves the right to release unsold seats if required

Most special events fall on a single date, and therefore date changes are not available. For special events that run across multiple dates, one date change is permitted up to 24-hours prior to travel for bookings with 1-9 guests and 14-days prior to travel for bookings with 10+ guests, with any difference in the fare payable by the customer. Please note, additional date changes incur a $20 per person fee, in addition to any difference in the fare

    All payments are non-refundable, and cancellations incur a 100% cancellation fee.

    If we’re unable to operate, no cancellation fees apply. You may seek a refund from the original place of purchase, or a credit can be made with Captain Cook Cruises Sydney towards another cruise within 3 years of original date of travel.     New Year's Eve Ticketed Special Event

    Full payment is required at the time of booking.

    *Agents: Credit Accounts are not available on Ticketed Special Events and limited commission applies.

    All payments are final and non-refundable.

    Gift Vouchers

    FOR THE PURCHASER

    Payment in full is required at the time of purchase. Cancellations and refunds are not permitted; however, vouchers can be exchanged for Cruise Cash subject to the below conditions.

    FOR THE RECEIVER

    Advance purchase
    • Gift vouchers cannot be redeemed within seven days of purchase
    Validity
    • Cruise Cash is valid for 3 years from the date of purchase, and can be used towards a public cruise of your choice
    • Promotional offers for a specific product
      - are valid for a limited time, usually 9-months (or 4-months for EOFY 2023 Sale), or for a specified operating period for seasonal products (e.g., Whale Watching season)
      - exclusion periods may apply
      - are not valid on special events unless otherwise stated
      - cannot be combined with any other offer
    Cruise Cash bookings
    • The total money value of the certificate can be used towards one (1) cruise booking only and unused or expired amounts cannot be refunded or credited for other cruises or services
    Requests for extensions
    • At the discretion of Captain Cook Cruises, a maximum one-month extension may be possible (depending on fare type or cruise purchased) providing reservations are contacted ph +61-2-9206 1111 at least one working day (Mon-Fri 9am-5pm) prior to the certificate expiry date.
    Unable to book a suitable date
    • If the cruise or promotional fare type is unavailable, the purchase price of the certificate can be exchanged for Cruise Cash, valid for up to 3 years from the time of original purchase. Refunds are not permitted.
    Expired vouchers
    • Expired cruise certificates cannot be extended, refunded, exchanged or redeemed for cash under any circumstances

      • Cancellation by the Customer:
        • 1-9 passengers: Cancellations notified less than 24 hours prior to sailing incur a 100% cancellation fee
        • Groups of 10 or more passengers: Cancellations notified less than 7-days prior to sailing incur a 100% cancellation fee
    • Group Allotments
      • Bookings are only considered confirmed when paid in full
      • Captain Cook Cruises at all times reserves the right to release unsold seats if required
      • If we become full on your departure and/or cruise type, full payment will become due 7-days of notification

    PROMOTIONAL FARES INCLUDING ONLINE SPECIALS

    Unless otherwise advised within the specific Promotion terms and conditions the following applies

    • Prices & Payment: as per Ticketed Cruises except
      • Prices are variable and valid at the time of payment only
      • Credit Accounts are not available with Promotional Fares – full payment is required at time of booking
      • Prices are commissionable to agents at 10%
    • Date Changes: as per Ticketed Cruises except
      • Subject to the sale and travel periods of the promotion
      • Any difference in the fare due to date change is payable at the time of change
    • Cancellation:
      • Cancellation by Captain Cook Cruises: Nil cancellation fee applies
      • Cancellation by the Customer
        • 1-9 passengers: Cancellations notified less than 24 hours prior to sailing incur a 100% cancellation fee
        • Groups of 10 or more: Cancellations notified less than 7-days prior to sailing incur a 100% cancellation fee
      • Should for any reason credit be approved for a particular Promotional Fare booking, the Customer agrees to guarantee and pay cancellations fees as outlined above
    • Group Allotments: as per Ticketed Cruises
    • Other Promotional Fare Terms and Conditions
      • Promotional Fares cannot be combined with any other offer
      • Promotional Fares do not apply to Special Events
      • Valid for sale for a limited time only and subject to change without notice
      • Block out periods may apply
      • Limited inventory - only a select number of tickets are available at Promotional Fares on any given departure

    TICKETED SPECIAL EVENTS

      • Credit Accounts are not available with Special Event fares – full payment is required at time of booking
      • Prices are commissionable at 10%
      • 1-9 passengers

        • Prices are variable and valid at the time of payment only
      • Groups of 10 or more passengers
        • All payments are final, non-refundable and payable as follows
          • 30% deposit to secure your booking
          • Balance due 14 days prior to departure
          • Please advise passenger numbers at the time of each payment
      • Date Changes:

          • Should for any reason credit be approved for a particular Special Event booking, the Customer agrees to guarantee and pay cancellation fees equivalent to the payment schedule as outlined above
        • Group Allotments: as per Ticketed Cruises
        • Other Special Events Terms and Conditions
          • Not valid with any special offer or Promotional Fare
          • FOC Tour Guides not permitted

    NEW YEAR'S EVE TICKETED SPECIAL EVENT

    Valid for New Year's Eve and other selected Special Events that may be released and notified on occasion

    • Prices, Payment & Cancellation:
      • Credit Accounts are not available with New Year's Eve - full payment is required at time of booking
      • Prices are commissionable at 10%
      • All payments are final and non-refundable

    SALE AGREEMENT

    • Captain Cook Cruises always reserves the right to disallow the resale of our products to third parties
    • Discounts to the Retail Rate cannot be advertised without prior agreement
    • Agents’ Nett rates and services stated in contracts are for FIT travel program inclusions and bundling/packaging and not for direct sale via Booking Agent’s customers who are end users (unless otherwise stated).

    GIFT VOUCHERS

    FOR THE PURCHASER

    CONDITIONS OF CARRIAGE

    1. In these conditions
      1. 'Company' means Captain Cook Cruises Pty Ltd and, where the context requires, its employees or agents.
      2. 'Passenger' means any person or persons on the cruise by virtue of this ticket.
    2. The Passenger acknowledges that during the cruise the vessel will be and remain under the absolute control of the Company and that the direction and control of the vessel and its crew is at all times the sole responsibility of the Master of the vessel. The Master of the vessel reserves the right to refuse entry of a passenger onto the vessel and to require a passenger to disembark the vessel in the Master’s sole discretion. The Passenger acknowledges that the Master of the vessel has the sole and absolute discretion to vary the scheduled route or destination of the cruise if for any reason the Master of the vessel considers it necessary for the safety and welfare of the vessel, its passengers and crew.
    3. The Company reserves the right to:
      1. Substitute any other vessel other than the one designated for the cruise (including a vessel not owned by the company) provided that the substituted vessel is of a similar type and includes similar facilities to the vessel named in the cruise;
      2. To cancel or abandon the cruise either before or during the cruise, if the Company or Master of the vessel considers in their sole and absolute discretion that the cancellation is necessary for reasons of weather or in the interest of the safety and well-being of the vessel, its passengers and crew and the Company will not be liable for any loss or expense incurred by the Passenger caused by such substitution or cancellation.
    4. To the extent permitted by law, the Company, its related entities, employees and agents shall not be liable for any claims, losses, damages, injuries, costs and expenses suffered, sustained or incurred (including but not limited to indirect or consequential) as a result of, or arising out of, or in any way connected with the cruise. The Passenger releases the Company for any claim whatsoever and howsoever incurred including but not limited to a claim for death bodily injury damage or loss of property during embarkation and/or disembarkation to or from the vessel and/or at all times whilst onboard the vessel itself, unless caused by wilful misconduct or reckless disregard of the Company. In the event of breach of any of these terms by the Company, or a failure in whole or in part to provide any service that the company contracted to provide (either expressly or by implication), the remedy for any such breach of any term shall be limited only to the contractual value of the performance of service or obligation that was not performed by the Company, or alternatively part value of the service where there was partial performance of the service or obligation by the Company. Any liability shall be assessed by the Company’s own value of the service and/or obligation or part thereof that is the subject of any claim.
    5. Passengers must not bring any alcoholic beverages or illegal substances onto the vessel.
    6. Boarding pass tickets are non-transferable and non-refundable and will not be replaced if lost, destroyed or damaged.
    7. Special conditions apply to private charter & event bookings. Contact the Charter department for details.
    8. Other Operators - Whilst all care is taken, no responsibility/liability whatsoever is borne or accepted by the Company for any other operator that is included, for any reason, as part of a package holiday, or conference or meeting within the Company's Ship. The Passenger agrees that any independent contractors with whom the Company so contracts provide their services subject to their usual terms and conditions.
